What if I can't find my paper work?
You will be asked to sign a mandate allowing our legal team to act on your behalf. This will allow us to request insurance policies and loan agreements from the companies involved.
What if I'm no longer in the loan/policy?
You can still reclaim your PPI providing the following are all true:
- The loan was taken out in the last 6 years
- You still have the paperwork
- You didn't make a successful claim against your PPI policy
Will making a claim affect my credit rating?
No. If it is proven that your credit agreement is not legally binding then the remainder of the debt can be written off. If this happens your lender cannot record a default against you. However, the lender may choose not to accept your custom in the future.
Can I make the claim myself?
Yes, but you will have the chance to make a higher value claim and greater chance of success with the help of our legal team. You can claim back your PPI charges yourself, but if you need to go to court to get the loan declared unenforceable you may have to cover the legal costs yourself.
Due to our legal teams expertise and existing relationships with major lenders the turnaround time is significantly quicker compared to making the claim yourself.
Our legal team will investigate your loan agreement and personal circumstances and will only take on your case if they believe there is a good chance that it is being a success.
Does it matter if I'm in an IVA?
We can still help you, however a proportion of the money reclaimed/written off must go into your IVA. We recommend that you speak to your IVA adviser for advice on this matter.
Does it matter if I am on a debt management program?
No, it doesn't matter at all.
